General Terms and Conditions for the Purchase of Online Vouchers
1) General:
The contract is concluded with Hettegger Hotel Edelweiss GmbH Unterberg 83, 5611 Großarl. Regulations deviating from this are only valid if they have been mutually, expressly and in writing agreed. Only persons over the age of 18 are entitled to purchase in our Internet shop.
2) Conclusion of contract, payment and delivery:
The vouchers offered on the hotel website represent a non-binding and non-binding purchase offer. The prices quoted are inclusive of any statutory value added tax. The online order of a voucher via the Internet represents a binding purchase offer by the customer, which Hettegger Hotel Edelweiss GmbH is entitled to accept within 48 hours by means of an order confirmation via e-mail, whereby the purchase contract is concluded. If no order confirmation is received within the aforementioned period, the purchase offer shall be deemed rejected and no purchase contract shall be concluded. After receipt of the payment owed on the basis of the concluded purchase contract, the purchased vouchers will be dispatched by Hettegger Hotel Edelweiss GmbH. In order to save shipping costs, the purchased vouchers can also be paid by credit card or Sofort Überweisung, in which case the vouchers can be sent free of charge via e-mail and printed out by the customer. If the customer so wishes, the vouchers will also be sent by post if they are paid for by credit card or instant bank transfer. No liability is accepted for any delays in delivery by post. If the voucher ordered online has already been sent to the customer before the payment to be made for it has been received or credited by Hettegger Hotel Edelweiss GmbH, the voucher shall not be valid until payment has been made in full and Hettegger Hotel Edelweiss GmbH shall be entitled to withhold the services evidenced by the voucher until the payment owed for it has been made in full.
3) Vouchers
In the case of online vouchers, it should be noted that these are transmitted to the customer by Hettegger Hotel Edelweiss GmbH with a forgery-proof code. Since the customer can print out the voucher himself, several prints are possible, but only one print is value-relevant and redeemable. The first voucher redeemed in the INCERT Voucher Management System with the corresponding barcode is considered the original and must be debited by Hettegger Hotel Edelweiss GmbH immediately after redemption. Should further copies with the same code appear, it is a case of misuse, which will result in criminal consequences. Since a voucher can be passed on or given as a gift, there is no obligation or possibility on the part of Hettegger Hotel Edelweiss GmbH to check the right of ownership of the redeemer. When redeeming the voucher, the system only checks whether the corresponding barcode has actually been released by the system and whether the corresponding voucher has actually been paid for. Lost vouchers will not be replaced. Vouchers cannot be returned for a cash value payment either. If the value of the voucher is more than the consumed service, a new voucher will be generated with the remaining value. In such a case, there is no entitlement to a cash payment of the voucher amount still outstanding. Hettegger Hotel Edelweiss GmbH is not obliged to accept unpaid vouchers as a means of payment. For operational reasons, the services listed in the voucher can only be provided or guaranteed by the establishment if a corresponding and timely reservation has been made. The service described in the voucher may vary slightly depending on the circumstances, but may not represent a relevant reduction in value for the guest. Should Hettegger Hotel Edelweiss GmbH have to close or give up for any reason, the online vouchers will expire without compensation. This is also the case if the business demonstrably changes ownership. In such a case, no recourse can be made to Hettegger Hotel Edelweiss GmbH as the original issuer of the vouchers.
4) Validity, period of validity:
Value vouchers have no expiry date and can be redeemed at any time. All other vouchers are redeemable upon prior request and availability and are valid for one year from the date of issue stated in the voucher. Each voucher can only be redeemed once, which is ensured by a barcode or voucher number linked to the voucher.
5) Cash redemption, invoicing:
Cash redemption of the voucher or the value evidenced by it is not possible. The issuing of a VAT-compliant invoice with corresponding proof of taxation can only take place at the time of the redemption of the voucher and thus the actual provision of the service.
6) Security guarantee, data protection:
Your security has the highest priority! Therefore, data such as credit card number, bank code, account number, name and address are transferred via certified payment providers via their protected SSL line, taking into account PCI guidelines. This means that no unauthorised person can read the data you enter during transmission on the Internet. In order to provide additional security in the voucher shop, we apply a number of additional security measures. Your details are processed by us with the aid of automated systems. Based on the general terms and conditions, the customer agrees to receive advertising information from Hettegger Hotel Edelweiss GmbH. This data will not be passed on to third parties.
7) Exchange, right of withdrawal:
Please return any vouchers that do not meet your expectations within 14 days of sending them to us. It is necessary that the written cancellation (revocation) declaration is received by Hettegger Hotel Edelweiss GmbH within 14 days. However, the right of withdrawal does not apply if the use of the service has already begun within the withdrawal period. This right of return only applies to customers who qualify as consumers. In the event of loss, theft or cancellation of vouchers, no compensation can be provided by Hettegger Hotel Edelweiss GmbH.
8) Place of jurisdiction:
Austrian law shall apply exclusively to all contractual relationships. The place of jurisdiction is the regional court, Austria.
